Civil Partnership Pre-Nups
Many same sex couples entering into a civil partnership will be interested in entering into a pre-civil partnership agreement.  Its purpose is similar to that of a pre-nup (see above) , namely to record what would happen to each party’s assets in the event the relationship breaks down.

It is common for a pre-civil partnership agreement to state that neither party will make any financial claim upon the other in the event of separation, dissolution of the civil partnership, or death.

It is extremely important that each party obtains independent legal advice to ensure that one party has not been pressurised into signing the agreement. Also both parties have to fully disclose their financial circumstances. 

The agreement should also be entered into a reasonable amount of time before the Civil Partnership ceremony and we recommend that it is signed at least two months beforehand.

Also, the terms must be fair and meet the needs of both parties and any children. The agreement should be reviewed regularly.
