Couples can often decide to separate but not immediately feel the need to pursue divorce. This can be for various reasons and the circumstances of each separation are unique. There can be disputes and misunderstanding over financial matters and what the arrangements for the children are going to be. Difficulties can arise even for those who separate on relatively good terms with each other. To avoid this some couples choose to record their terms for separation in a Separation Agreement.
In other cases couples are sure they want to go ahead with divorce or dissolution of civil partnership. Either is fairly straightforward however the decisions regarding financial settlement and property plus the arrangements for the children can be trickier to deal with. It is essential to take legal advice from a lawyer who specialises in family and divorce law at an early stage. If a separating/divorcing couple can agree things between themselves, even though lawyers need to be involved, their respective legal costs can be kept to a minimum. Divorce in England & Wales is currently granted on the basis of the irretrievable breakdown of marriage supported by the fact of adultery, unreasonable behaviour, desertion, two years separation with consent, or five years separation without consent.
