Pre-Nups
Prenuptial agreements, also known as ‘pre-nups’, are becoming increasingly important., A pre-nup is a private agreement between a couple who are due to marry that sets out financial matters in case of future separation, divorce and death.

A high divorce rate and the trend towards marrying later in life and increased life expectancy means that some couples wish to have an agreement in place before marriage rather than negotiating terms if the marriage fails for any reason.

It is extremely important that each party obtains independent legal advice to ensure that one party has not been pressurised into singing the pre-nup. Both parties also have to fully disclosure their financial circumstances.

The pre-nup should also be entered into a reasonable amount of time before the wedding and we recommend that it is signed two months beforehand. The terms must be demonstrably fair and meet the needs of both parties and the children. Pre-nups should be reviewed regularly.
