Boundary Disputes
At DWT we are experienced at dealing with boundary disputes. We have dealt with cases involving adverse possession, poor boundary descriptions, and where access is needed to a neighbouring land but is not permitted. We have also experience of cases where it is not known who is responsible for maintaining the boundary, where the boundaries have changed due to encroachment (occupation without permission), cases involving nuisance and party walls, overhanging trees, hedges and Tree Preservation Orders.

When boundary disputes arise, many feel the only practical option is to go to court as there is nobody lower down who can deal with these. However, insufficient use is being made of alternative disputes resolution procedures such as mediation and arbitration. Whilst the office of Adjudicator to HM Land Registry, reduces the number of cases taken to the County Court, it is itself a court of law.
