Investigation of Title


Investigation of title is the process by which a title to property is examined. Investigation of title will be carried out by the solicitor representing:

  • A buyer of freehold or leasehold property or the prospective tenant under a lease, to establish that:

- The seller is legally able to transfer the title to the property and

- There are no defects in that title that would adversely affect the buyer's interests.

  • A seller or landlord, to establish:

- How to draft the contract, transfer or lease.

- If there are any title defects which need to be resolved and/or disclosed to the buyer.

- How to prepare any certificate on title.

  • A lender taking security over the property, to establish that:

- There are no defects in title that might adversely affect the value of the property or the ability of the lender to sell the property to realise its security.

If there are any matters that are not clear or are not satisfactory, these are raised by the solicitor acting accordingly.
