Surveys
Although there is no obligation to do so, we will almost always advise our clients to have a survey carried out on the property they wish to purchase. If the property is being mortgaged by way of security, the mortgage lender will almost always require a survey to be carried out. The principle of caveat emptor applies, which means buyer beware: the buyer will take the property in the physical condition that it is in, regardless of the state of their knowledge.

Depending on the scope of the instructions, the survey should:

  • Warn of issues of which the surveyor may have local knowledge, that may affect the decision to buy, and that require further investigation, for example, the existence of rivers or rail links or planning proposals.
  • Warn of potential structural problems and any major or minor repair works that may be needed in the near future.
  • Confirm value, although this may be dealt with in a separate valuation report.
  • Confirm whether the physical boundaries correspond with the boundaries shown in the title deeds and whether any of these are unclear.
  • Identify physical defects in the property, including structural defects.
  • Warn of factors that may indicate third party rights or interests that require further investigation.
